This Vendor of Record Arrangement was established for the acquisition of Temporary Help Services, in accordance with the terms and conditions of Tender 6484.

The term of this arrangement is for three (3) years with the option to extend for an additional two (2) two-year terms in accordance with the same terms and conditions of Tender 6484.

Effective January 1, 2019 changes to the Employment Standards Act came into effect. We want to take this opportunity to highlight the changes and to provide important information to assist in ensuring compliance with the new legislation.

The changes in the equal pay provision no longer require that the resource be paid the same rate as the position being filled.

The Second Stage Selection Process will reflect that change in the law. Whereas OPS clients previously provided the resource hourly rate in the Request for Services/Statement of Work form, it will now be the vendor’s responsibility to provide a competitive hourly rate as well as the markup percentage. A vendor can propose a lower markup percentage rate, but not greater than the rate set out in the Master Vendor of Record Agreement.

In the Second Stage Selection Process, OPS clients will provide a role description with a suggested hourly rate. The vendors will respond with a competitive vendor hourly rate as well as a markup percentage.

The markup percentage rate plus the hourly rate indicated in the RFS/SOW will be applied to the job assignment and paid to the vendor.

As before, the vendor hourly rate is the rate of pay for the resource.

The RFS_SOW form is labelled as “Recommended Hourly Rate to be paid to the Temporary Help resource,” “Vendor Hourly Rate to be paid to the Temporary Help resource” and “Mark-Up Percentage Rate” respectively.
